Membership terms & services
Gyn Aesthetics and Wellness is authorized to charge the amount that I have submitted automatic debit from my bank account that I have authorized on the date(s) indicated in this Membership Agreement.
MEMBERSHIP SERVICES: Services do not accumulate. For example, if you choose not to use your service in a given year, you cannot “roll over” that service into a subsequent year. You may continue to redeem your membership
services as long as your membership is in effect and is current. “Current” is defined as I. sufficient funds are available in Buyer’s account or debits are otherwise accepted, as well as I. Gyn Aesthetics and Wellness has the right to cancel this agreement when the Buyer is not current during or after the initial 1-year contract term. Upon termination or cancellation of your membership, all unused services will expire 30 days after the final membership payment has been processed. No refunds will be given for any remaining unused services.
PAID IN FULL MEMBERSHIPS. Services can be redeemed within 1-year. Membership with no automatic renew. All unused services will expire 30 days after the 1-year commitment. No refunds will be given for any remaining unused services.
Gyn Aesthetics and Wellness recommends that you consult your physician, if necessary, before beginning any body or skin care treatments as well as any other spa services or physical activities that are offered by a Gyn Aesthetics and Wellness. Anyone with a history of health problems should consult a physician before becoming a Wellness Member. Any conflict between the original Wellness Membership Agreement and any copy of the original Wellness Membership Agreement shall be controlled by the original Wellness Membership Agreement.
By signing this Wellness Membership Agreement, Buyer acknowledges that Buyer is of legal age; has received a filled-in and completed copy of this Wellness Membership Agreement that identifies the Wellness Membership type; has read and understands the entire Wellness Membership Agreement that includes but is not limited to the *EFT/CC Request (if applicable), and has an understanding of the Release & Wavier or Liability & Indemnity.
HOW TO CANCEL YOUR WELLNESS MEMBERSHIP: You may cancel your Wellness Membership (and thereby the continued billing of the Wellness Membership fee from your bank account each month) by providing written notice of your request at least thirty days before your billing date. It is recommended that you send your cancellation notice by registered or certified mail, return receipt requested, or statutory overnight delivery to prove that you did cancel. If you do hand-deliver your cancellation, be sure to get a signed statement from a representative of Gyn Aesthetics and Wellness that acknowledges your cancellation. To be effective, your cancellation must be postmarked by midnight or hand delivered by midnight 30 days before the next payment date, and it must include a copy of the Wellness Membership Agreement signed by you.
If the notice is postmarked at least 30 days before your next billing date, no further billing will occur. If the notice is postmarked less than 30 days before your next payment date, you, the Wellness Member, will receive one more billing date. You may use any unused services for 30 days after the final membership payment has been processed. No refunds will be given for any remaining unused services. TERMINATION FEE: If you do not make payments for the minimum contract period of 1 year and cancel for any reason during this time, you as the buyer understand that you are responsible for a $100 early termination fee and the total amount of payments due under the contract, whichever is greater.
NON-PAYMENT: If sufficient funds are not available in the Buyer’s account or debits are otherwise not accepted, Gyn Aesthetics and Wellness may resubmit the charge up to 7 days after the scheduled EFT. If the Wellness Membership fee is returned uncollected, the contract will be canceled due to non-payment resulting in early termination fees, if applicable.
CHARGES: Buyer understands that Buyer is entitled to a notice of all varying charges and withdrawals under the EFT, but Buyer waives the right to receive prior notice for charges or withdrawals concerning any uncollected monthly fees, payments, or portions of the balance due described above and the corresponding service charges, both of which Buyer agrees are not varying charges or withdrawals.
You (the Member) have three business days to cancel this agreement from the date of purchase. If you cancel, any payments made while service has not been rendered will be refunded.
